本書は<著作権者が政治過程に影響力をもっているから>と答えている。

●本書の結論

本書の結論は<国民がもっと政治過程に関心をもち監視していかなければならない>。これは著作権に限らずすべての立法において言えることで、審議会政治などと呼ばれ政治学などでよく知られた事柄だが、重要だ。このように官僚が審議会で利益団体の利害を調整し、意図する結論を出し、政治家(内閣・国会)にはそのまま立法させるという省庁代表制・官僚内閣制が日本政治の根本的な問題だからだ。なぜ根本的か言うまでもないが民主制に反するからだ。官僚は民主的正統性をもたない。

自分の言い方では「『広く弱い利害』をもつ集団から『狭く強い利害』をもつ集団に利益が移転される」ということ。
